Producer Statements and Technical Literature Statement of Compliance

When are these statements used?

A Building Consent Authority (Council) can use Producer Statements or memoranda to recognise the assurance of building professionals and some trades that building work design and construction is, or will be, technically acceptable and will satisfy the provisions of the Building Consent.

The Council may rely on a Producer Statement or memorandum as "reasonable grounds" for assuring compliance. It is important that your Council can be confident of the reliability of these statements and that the statements' authors have appropriate experience and competence in their field(s).

What is a producer statement?

Producer statements are formal written statements certifying that specific building work, designs or specifications comply with technical requirements to comply with the provision of the NZBC supplied and signed by a recognized specialist such as an engineer or architect or applicator etc on behalf of:

• an applicant for building consent, or
• by or on behalf of a person who has carried out building work

These statements confirm that certain work will be, or has been carried out, in accordance with nominated performance requirements of the building code or conditions of consent. A producer statement will usually be in the form of a certificate or written statement, signed by a design professional or constructor.

What is a Statement of Compliance?

A statement of compliance is like a producer statement but is signed and written by tradesmen for specialist work to confirm that the work that they have undertaken meets the performance requirements of the NZ Building Code or a Building Consent. You can download the form here:

If information is missing or inadequate the Producer Statement or Statement of Compliance will not be accepted.

Why is a producer statement necessary?

Rotorua Lakes Council chooses to accept producer statements and technical literature for critical building activities that they may not have the in-house competence to assess or confirm that certain works or products are installed to the designers or manufactures specifications etc. The Council may rely on a Producer Statement or memorandum as "reasonable grounds" for assuring compliance. It is important that your Council can be confident of the reliability of these statements and that the statements' authors have appropriate experience and competence in their field(s).

These activities may include:

• geotechnical
• structural
• civil
• mechanical
• hydraulic
• fire design
• acoustic
• heating, ventilation and air-conditioning and
• electrical
• hazardous substances and processes

We may also, at our discretion, accept Technical literature statements (or Statement of Compliance) for other building work or related activities which may not have been observed by one of our inspectors, such as:

• Waterproofing, and
• Installation of specified systems
• Ventilation systems / HVAC Systems
• Glazing - for residential, if specific designed or for commercial project e.g. curtain walling etc.
• Effluent systems
• Paint systems e.g. Intumescent paint systems
• Interior and exterior waterproofing, tanking, internal wet areas etc. Used by tilers and by roofers to confirm that they have installed water proof membranes in accordance with the manufacturer's specifications and that the installation complies with the approved building consent.
• Fire Protection / Fire Detection: Fire alarm systems, sprinkler systems, emergency lighting, etc. (residential)
• Pipe pressure tests - Used by Certified plumbers to confirm performance of pipe work at the required water pressure level.
• Exterior plaster - Solid, propriety solid plaster, exterior wall coating - used by plasterers and painters to confirm that they have applied the product to the manufacturers specifications and in accordance with the approved building consent.
• Lefts and elevators (residential)
• Automatic doors and emergency release doors

Producer statements will only be accepted in accordance with the following conditions:

• TA record-keeping purposes all producer statements must be accompanied by engineering calculations and construction details (where relevant)
• Producer statements involving engineering design (mechanical, structural, civil, fire, etc.) will only be accepted from a Charter Professional Engineer although a
• Producer statement design may be accepted from a recognised author for such things as truss manufacturer, pole sheds, or proprietary beams (Hyspan, etc).
• A producer statement construction (PS3) may be accepted from a suitably qualified person where a building work or activity has not been inspected (i.e. fire alarm or emergency lighting system)
• A producer statement construction review (PS4) may be required where a designer (engineer) has made design assumptions or where Council may deem this necessary; in such circumstances the scope of engagement will be agreed between Council and the applicant before the building consent is issued
• Producer statements design, design review and construction review will only be accepted if they are supplied by a chartered professional engineer on an IPENZ form
• We reserve the right to accept or reject producer statements without prejudice
