Subject: FW: LGOIMA request for legal and regulatory documentation on the Tarawera Sewerage pipeline
I refer to your Local Government Official Information and Meetings Act request of 31 August 2024 regarding legal and regulatory documentation on the Tarawera Sewerage pipeline, and respond to your specific requests below:
1. Details on the legal advice obtained by the Rotorua Lakes Council regarding the ability to proceed with the sewage pipeline near Lake Rotokākahi, including any identified risks.
Attached is a letter sent to Lake Tarawera ratepayers on the ruling of the District Court Judge following Council’s application for an injunction to prevent unlawful interference and disruption to the Tarawera Sewerage Scheme.

2. Copies of all resource consents and conditions related to the protection of cultural and environmental sites near the pipeline route, particularly those pertaining to Lake Rotokākahi.
Resource consent is not required for thrusting pipeline under the road in the road corridor.
Additionally, resource consent is not required for works in and around the Te Wairoa Stream as the activity complies with the conditions specified in the BOP Regional Natural Resources Plan, rule BW R9 (Rule 56)- Bay of Plenty Natural Resources Plan (updated 2023). The works are considered a permitted activity under this Plan.
