I refer to your LGOIMA (Act) request of 3 May 2022 for:
* all minutes of the public-excluded discussion of the Rotorua District Council (Representation Arrangements) Bill;
* any video of that discussion (for example, that taken by the cameras which normally provide the livestream).
Below is an extract from the DRAFT minutes of the public session of the Council meeting held on 28 April.
Note: The minutes remain DRAFT until adopted at the Council meeting on 26 May.

URGENT ITEMS NOT ON THE AGENDA
- The Chair advised that an urgent item concerning the Rotorua District Council (Representation Arrangements) Bill, and to enable a discussion in response to the Attorney General’s request for further information, will be discussed during confidential.
Cr Macpherson raised a point of order to request that this be discussed in public.
The Chair declined the point of order and reiterated this would be discussed in confidential.

RESOLUTION TO GO INTO PUBLIC EXCLUDED
RESOLVED
That Council move into Public Excluded session to discuss and consider the following items; the confidential minutes from the meeting 31 March 2022, Recommendations from other Committees, and discuss the Rotorua District Council (Representation Arrangements) Bill. The reasons are to enable commercial activities and to prevent the use of information for improper gain or advantage.

The confidential minutes are withheld as per the above sections of the Act.
The livestream cameras are turned off at the end of the public session therefore there is no video recording. This part of your request is declined under section 17(e) of the Act as the information requested does not exist.
The Mayor released a statement following the meeting on the result of the discussion during the confidential session regarding the Bill. This statement can be found on Council’s website HERE.
