Subject: Request for information under LGOIMA - lakefront walkway and Tarewa Road
I refer to your email of 18 November 2019 under the Local Government Official Information and Meetings Act, and respond below as per your email:
- What are the rental payments to be to Te Arawa Lakes Trust for using the lakebed to support the new lakefront walkway.Annual rent is $10,000 per year for 50 years.
- What are the review terms for those rental payments.The rent is CPI adjusted every three years.With reference to the poor quality of the recently upgraded roadworks and repairs on Tarewa Road.
- Who is financially responsible for the ongoing repairs that will be required for this project.The contract is in the Defects Liability Period where the contractor is responsible for rectification of any defects. RLC holds retention funds against the contract to ensure this is done. It is up to the contractor however to programme the work.
- What is the length of time that that party will be responsible for those ongoing repairs.The defects liability period is six months.
- Has the contractor met the standard quality requirements for workmanship on this project.Defects on projects such as this are not uncommon and may appear over a period of time. On Tarewa Road some repairs are temporary pending permanent repairs which will be programmed in order that a second coat seal occurs shortly after. A second coat seal is standard practice and has always been planned. It is undertaken, however, some months following the first coat.
- Has the contractor met the standard quality requirements for the repairs completed to date.While RLC would like to see no defects on a project, Council understand that defects do occur and RLC has the contractual mechanisms in place to deal with these. RLC is comfortable with how Tarewa Road is being managed.
