Topic: Changes to terms and conditions relating to parking building
Enquiry
Re item in agenda of Thursday's council meeting regarding parking building upgrades and proposed changes to terms and conditions -
(3c pg 15) Section 1: Payment: It was noted that applicable fees included any credit/debit card fees and SMS receipt fees and that these applicable fees need to be included in any reference to parking charges within the terms and conditions. To achieve this, a definition of parking charges was inserted in the introduction.
Was this definition not in the previous terms and conditions for the parking building, or was it not needed because iPark was not managing the parking in the building?
I understand they have been managing the parking in the building since March this year. Is it possible any credit or debit card fees, or SMS receipt fees were not included in the terms and conditions from then til now? If so, would any of those charges be enforceable/valid/legal?
If so, have those charges been enforced? How many and what are the total charges in dollars?
Response
From Council's Group Manager Operations, Jocelyn Mikaere:
The new definition is based on legal advice following a review of our terms and conditions and to align with the timing of i-Park taking over the management of the parking building from 8 June 2020. This reflects changes to the system, such as the option to receive an SMS receipt, which wasn't previously available.
Council remains in charge of parking building operations until i-Park takes over its management on 8 June.
