Subject: LGOIMA request - Lumbercube noise monitoring
I acknowledge your request of 25 May 2016 for official information held by Rotorua Lakes Council which we have considered as a request made under the Local Government Official Information and Meetings Act 1987 (‘LGOIMA’). Responses to the questions are as follows:
* How many times the council carried out noise monitoring or Lumbercube?
* Please provide details of each monitoring including the date, location monitoring was carried out and decibel readings recorded.
* How many times has it exceeded limits?
Noise monitoring undertaken by Council and the collection and assessment of data from that noise monitoring has
been undertaken pursuant to an investigation under the Resource Management Act 1991 and pursuant to the
instructions of Council’s solicitors, Tompkins Wake. Accordingly, the information you have requested above is
withheld pursuant to the following sections of LGOIMA:
- Section 6(a) – making the data available would be likely to prejudice Council’s investigation under the RMA; and
- Section 7(g) – withholding the data is necessary to maintain legal professional privilege.
* How much has the council spent on noise monitoring of Lumbercube?
Council has incurred costs of $22,338 to Watchdog for after hours noise responses. Staff time is not recorded
separately for each activity so we are unable to give a figure for staff time involved in Lumbercube noise monitoring.
